Terms and Conditions for LegacyQR

These Terms apply to LegacyQR at https://www.legacy-qr.net.

1. Acceptance of Terms

By accessing, browsing, creating an account, uploading content, purchasing services, scanning a QR code linked to our platform, or otherwise using our website and services (the "Platform"), you agree to be bound by these Terms and Conditions. If you do not agree with these Terms, you must not use the Platform.

2. Description of Services

The Platform provides digital memorial services, including but not limited to:

  • Memorial profile pages
  • Biographies and life stories
  • Photo and video galleries
  • QR code memorial links
  • Tribute messages and guestbooks
  • Family and contributor submissions
  • Media hosting and sharing
  • Related memorial services and features

We reserve the right to modify, suspend, or discontinue any feature at any time without prior notice.

3. User Accounts and Security

Users are responsible for:

  • Maintaining the confidentiality of account credentials
  • Restricting unauthorized access to their account
  • All activities occurring under their account

While we implement commercially reasonable security measures, no online system can be guaranteed to be completely secure. Users acknowledge and accept the inherent risks associated with internet-based services.

4. Ownership and Responsibility for Content

You retain ownership of all content uploaded to the Platform, including photographs, videos, audio recordings, text, documents, and memorial information.

By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, backup, process, and distribute such content solely for the purpose of operating and improving the Platform.

You represent and warrant that you own the content or possess all necessary rights and permissions to upload it; that the content does not infringe any copyright, trademark, privacy, publicity, or other legal rights; and that you have obtained consent from any identifiable living individuals appearing in photographs or videos where required by law.

5. Photos, Videos, and Media Content

The Platform may contain photographs, videos, and other media uploaded by users. By uploading media, you acknowledge and agree that you are solely responsible for the legality and accuracy of such media; that you have obtained all required permissions from rights holders and identifiable individuals; that we do not verify ownership, authenticity, or accuracy of uploaded content; and that we are not responsible for disputes regarding copyrights, likeness rights, privacy rights, or ownership claims.

If a valid complaint is received regarding uploaded content, we reserve the right to remove or restrict access to such content without notice.

6. Memorial Privacy and Public QR Access

Every memorial begins as a private draft. Purchasing a QR sticker or plate does not publish the memorial. Visitors who scan a code or open a link see only what you have chosen to share.

You may keep a memorial as a draft, lock a published memorial with a visitor password for close family, or open it to the public. Guestbook messages may wait for your approval before they appear.

When a memorial is public, anyone with the QR code or page URL may view the content. Public content may be copied, downloaded, shared, indexed by search engines, archived, or reproduced by third parties. We cannot control screenshots, downloads, caching, or redistribution performed by visitors.

Once content is made public, complete removal from the internet cannot be guaranteed.

7. Prohibited Content

Users may not upload, publish, or distribute content that violates any law; infringes intellectual property rights; contains malware, viruses, or malicious code; promotes violence, hatred, harassment, or discrimination; is fraudulent, misleading, defamatory, or deceptive; violates privacy rights; or contains obscene or illegal material.

We reserve the right to remove content or terminate accounts at our sole discretion.

8. Service Availability

We strive to maintain continuous availability of the Platform. However, we do not guarantee uninterrupted access. The Platform may experience maintenance interruptions, technical failures, network outages, third-party service disruptions, and data transmission delays.

We shall not be liable for any losses resulting from service interruptions.

9. Data Storage and Backups

Although we maintain backup systems, users are solely responsible for maintaining independent copies of their photographs, videos, memorial records, and other content.

We do not guarantee permanent storage of uploaded content.

10. Cybersecurity and Limitation of Liability

While we employ reasonable administrative, technical, and organizational safeguards to protect our systems and user data, no website, server, database, cloud provider, software application, or internet transmission can be guaranteed to be completely secure.

Users acknowledge and agree that unauthorized access, hacking attempts, cyberattacks, malware infections, ransomware incidents, data breaches, service disruptions, and other cybersecurity events may occur despite reasonable security measures; that we do not warrant that the Platform will be free from vulnerabilities, security incidents, or unauthorized access; that we are not responsible for damages, losses, unauthorized disclosures, content alteration, deletion, corruption, theft, interception, or misuse of information resulting from events beyond our reasonable control; and that users assume the risks inherent in transmitting and storing information electronically.

To the fullest extent permitted by applicable law, the Platform, its owners, affiliates, directors, employees, contractors, and partners shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from cyberattacks, unauthorized access, security breaches, data loss, data corruption, service outages, third-party system failures, internet failures, cloud infrastructure failures, or user negligence or credential compromise.

11. Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis.

We expressly disclaim all warranties, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and security.

We do not guarantee that memorial pages, photos, videos, or other content will remain permanently accessible.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability arising from any claim related to the Platform shall not exceed the amount paid by the user during the twelve (12) months preceding the event giving rise to the claim.

In no event shall we be liable for emotional distress, reputational harm, loss of memories, loss of data, loss of profits, loss of business opportunities, or indirect or consequential damages.

13. Indemnification

You agree to defend, indemnify, and hold harmless the Platform, its owners, employees, contractors, affiliates, and partners from any claims, damages, liabilities, losses, costs, or expenses arising from your uploaded content, violation of these Terms, violation of applicable laws, or infringement of third-party rights.

14. Termination

We reserve the right to suspend, restrict, or terminate access to the Platform at any time for violations of these Terms or for operational, security, legal, or business reasons.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Province of Quebec and the applicable federal laws of Canada.

Any disputes shall be submitted to the competent courts located in Quebec, Canada.

16. Changes to Terms

We may update these Terms at any time. Continued use of the Platform following publication of updated Terms constitutes acceptance of the revised Terms.
